GENERAL TERMS AND CONDITIONS

PFG Plumbing and Gas – Terms & Conditions of Trade

1. Payment Terms
All work is strictly Cash on Delivery (COD) unless otherwise agreed in writing prior to commencement. We accept bank transfer, PayID, or card payments on site.

2. Late Payment Fees
Invoices overdue by more than 7 days will attract penalty interest at 0.05% per day, calculated daily.

3. Ownership of Goods
Ownership of goods and materials remains with PFG Plumbing and Gas Pty Ltd ABN 88 686 675 712 until payment is received in full.

4. Security Interest (PPSA)
Until full payment is made, goods must be stored so they are clearly identifiable as our property. The Customer grants PFG Plumbing and Gas a Purchase Money Security Interest (PMSI) under the Personal Property Securities Act 2009 (Cth) and we reserve the right to register this interest on the PPSR.

5. Repossession and Recovery
In the event of non-payment, we may repossess supplied goods and recover associated costs. After 90 days, repossessed goods may be sold and proceeds applied against outstanding debt.

6. Debt Recovery Costs
The Customer is liable for all debt recovery fees, including legal, administrative, and third-party collection charges.

7. PPSA Acknowledgement
These terms form a Security Agreement under the PPSA. We may register a Financing Statement or Change Statement, and lodge caveats on any Customer-owned property in case of default.

8. Default Conditions
If default occurs, the Customer authorises us to act as their attorney for property-related dealings and security enforcement.

9. Acting as Trustee or Agent
Where the Customer acts as a trustee or agent, they confirm they are authorised and personally liable for the agreement.

10. Governing Law
This agreement is governed by the laws of Western Australia, and both parties submit to the jurisdiction of its courts.


Additional Terms

11. Minimum Charges and Billing Increments
A 1-hour minimum charge applies to all bookings. Additional time is billed in 15-minute increments.

12. Cancellation & No-Show Fees
Cancellations made with less than 24 hours’ notice may incur a $140 + GST fee. If the technician cannot access the site, a full callout charge may still apply.

13. Variations to Quoted Work
Work outside the original quote or scope may incur extra charges, with costs recorded on the job card and/or invoice.

14. Warranty Exclusions for Supplied Materials
No warranty is offered on fixtures or products supplied by the Customer. Warranty applies only to products provided by PFG Plumbing and Gas.

15. Access Requirements & Site Safety
The Customer must ensure safe and clear access to all work areas. If unsafe or obstructed, the technician may leave and a callout fee will apply.

16. Force Majeure
We are not liable for delays caused by circumstances beyond our control, including weather, illness, traffic, or supplier issues.

17. Digital Communication & Consent
By engaging our services, the Customer agrees to receive quotes, updates, and invoices via email and/or SMS.

18. Limitation of Liability
To the maximum extent permitted by law, PFG Plumbing and Gas will not be liable for any indirect, incidental, special, or consequential loss or damage (including loss of income, loss of use, or loss of opportunity) arising from any service provided, except to the extent caused by gross negligence or wilful misconduct.

19. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Product Liability
Where PFG Plumbing and Gas supplies goods or fixtures, our liability is limited (at our option) to repair, replacement, or refund of the item’s purchase value. We are not liable for any consequential damage caused by product failure.

21. Return Visits & Recall Policy
All return visits to site are considered chargeable callouts by default. A return visit will only be classified as a recall (non-chargeable) after the issue has been inspected by PFG Plumbing and Gas and confirmed to be:

  • Directly related to the original work performed, and

  • Caused by workmanship or product supplied by us.
    Issues unrelated to the original work, caused by external factors, misuse, third parties, or new faults will be charged at our standard rates.


Leak Detection Investigative Damage Waiver

By booking leak detection services with PFG Plumbing and Gas, the Customer acknowledges and agrees to the following:

Invasive Work
Leak detection may require drilling, cutting, or other invasive work that could cause surface damage.

Customer Consent
The Customer agrees that such work is necessary and consents to it being carried out.

Liability Waiver
The Customer waives all claims for damage caused during investigation, unless due to gross negligence or wilful misconduct by PFG Plumbing and Gas.

Damage Documentation
All investigative damage will be documented in writing and supported by photos.

Limitation of Scope
This waiver applies to investigative work only. Permanent repairs or restoration work are not included and may be quoted separately.

Third-Party Trades
If repairs require other trades (e.g. tiling, electrical, landscaping), the Customer is responsible for arranging this unless otherwise agreed in writing.

Access Requirements
The Customer must provide safe, clear access to leak areas. If our technician is required to move furniture or clear obstructions, this time will be billed at our standard rate.

Acknowledgement
By booking a service with PFG Plumbing and Gas, the Customer confirms they have read, understood, and accepted the above terms, including this waiver. This acceptance applies whether the service was booked via phone, email, web form, or other communication.


Blocked Drain Recurrence Liability Waiver

This waiver applies where a Customer declines a recommended camera inspection following a blocked drain service.

Camera Inspection Recommendation
PFG Plumbing and Gas recommended a drain camera inspection to identify the cause of the blockage and prevent future issues.

Inspection Declined
The Customer chose not to proceed with the recommended inspection.

Release of Responsibility
PFG Plumbing and Gas is not responsible for any future drain blockages unless directly caused by our gross negligence or misconduct.

Scope Limitation
This waiver applies only to the blockage cleared during this visit. New blockages or issues elsewhere in the system are treated as separate incidents.

High-Risk Properties
Properties with earthenware pipes, tree root intrusion, or structural damage are at higher risk of recurring issues. By declining the inspection, the Customer accepts full responsibility for these risks.

Future Callouts
In the event of recurrence, a drain camera inspection may be required at the Customer’s cost before further work is undertaken.

Acknowledgement
By booking a service with PFG Plumbing and Gas, the Customer confirms they have read, understood, and accepted the above terms, including this waiver. This acceptance applies whether the service was booked via phone, email, web form, or other communication.
